YOU BETTER STAND UP FOR, MS. WEST!

Kanye and the rest of the Glow in the Dark crew recently played Denver at the Pepsi Center last night. As usual, I heard it was off the hook. The only thing is a little controversy was stirred during Ye's set when he was doing a tribute to his mom and someone in the first few rows was sitting down. He asked the crowd to stand up but was clearly looking right at whoever was sitting because the whole crowd was up. He asked again and then on the verge of a Kanye freak out he looked right at the person and said "stand up out of respect...everyone stand up, unless you are in a wheelchair". I don’t know if the person got up, but they might have been in a wheelchair. If my poor memory is right, this happened before with ‘Ye and wheelchair-bound person.

IS WHITNEY BACK ON THAT "LEAN" AGAIN?
“R&B diva Whitney Houston disappointed a sold-out crowd who came to see a rare performance by the trouble-prone singer at the Plymouth Jazz Festival in Tobago on Sunday. Houston opened her show with ‘Its Not Right, But Its Okay’ and by her third song, ‘Saving All My Love,’ the once soprano’s newfound tenor tone was in full rasp. Wearing a white gown with a single shoulder strap, Houston skipped around the stage and continuously shouted to the crowd: ‘I love you Trinidad !’ Unfortunately, the concert was in Tobago! Locals shouted back each time: ‘This is Tobago!’”

--That's one of the worst things that could happen to her...I mean if you've ever been on a stage for a major show you would know that they tape the location of the venue (phonetically ) on the floor in plain sight of the artist(s). This is a travesty for Whitney fans around the room. Put down the rocks immediately and pick up some common sense. F***!

Bush: No "Magic Wand" To Lower Gas Prices

WASHINGTON (Reuters) - U.S. President George W. Bush said on Tuesday there was no "magic wand" to bring down record-high fuel prices but would consider a proposal to suspend federal gasoline taxes this summer -- an idea that has divided the 2008 presidential candidates.

Trying to calm anxious Americans facing $3.60 a gallon gasoline and soaring grocery bills, Bush again prodded Congress to open an Alaska wildlife refuge to oil drilling and allow construction of more nuclear and coal plants.

"I firmly believe that, you know, if there was a magic wand to wave, I'd be waving it, of course," he said during a news conference. "I've repeatedly submitted proposals to help address these problems, yet time after time Congress chose to block them."

Crude oil prices have surged more than five-fold since 2002, heaping more pressure on a waning U.S. economy besieged by dropping home values and rising food prices.

Oil prices are up nearly 25 percent since the start of 2008, logging a record near $119.93 a barrel this week, and gasoline prices are above the key $4 a gallon mark in some U.S. cities like San Francisco.

Giant U.S. oil company Exxon Mobil Corp will report its quarterly profits this week, after ConocoPhillips, Royal Dutch Shell and BP all reported quarterly profit increases from a year ago.

Presumed Republican presidential nominee Sen. John McCain and Democratic rival Hillary Clinton have both endorsed suspending an 18.4 cent per gallon federal gasoline tax this summer, but fellow Democratic hopeful Barack Obama has argued that it would make little difference.

Clinton, a New York senator and former first lady, has used the gas tax issue to differentiate herself from Obama, an Illinois senator, as they fight ahead of the nominating contests in Indiana and North Carolina next week.

Bush said he was willing to consider suspending gasoline taxes.

"We'll let the candidates argue out their ideas," Bush said. "If it's a good idea, we embrace it. If not, we're analyzing the different ideas coming forward."

However, Bush again rebuffed calls from U.S. lawmakers to suspend filling the nation's emergency oil stockpile to boost supplies -- saying that U.S. reserve shipments amount to one-tenth of 1 percent of global oil demand.

Senate Democrats are pursuing legislation that would bar the federal government from socking away oil until prices fall, and 16 Republican senators on Tuesday said oil shipments should stop. All three presidential hopefuls support such a move.

"I support an immediate halt in the deposits of domestic crude into the (oil reserve) as we enter the busiest driving season of the year," said Sen. Kay Bailey Hutchison, a Texas Republican.

Democrats also slammed Bush, arguing oil from the Alaska refuge would not produce oil for a decade. "And it's estimated that if they drilled (there) in 20 years it would reduce the price one penny," said New York Sen. Charles Schumer.

Bush has repeatedly called on OPEC -- source of about a third of global oil supplies -- to boost production to tame record prices, but so far cartel members have rejected output hikes.

Bush declined to say whether he will pressure Saudi Arabia -- OPEC's top exporter -- to boost output when he visits the kingdom next month.

"To your question on the Saudis, look, I have made the case that, you know, the high price of oil injures economies," Bush said. "But I think we better understand that there's not a lot of excess capacity in this world right now."

---If this cat would call up his buddies and tell them to tone it down because it would help the GOP in this election year, I'm sure they would. I really hope McCain has a great insurance plan and a semi-young VP to take over when his hip dysplacia starts acting up again. Bush is a bum! think about it....

Gamers Line Up For Release of GRAND THEFT AUTO IV

NEW YORK/LOS ANGELES (Reuters) - "Grand Theft Auto 4" went on sale Tuesday, with fans lining up at midnight to grab the first copies of the criminal action game hailed as a brutal and satirical masterpiece equal to films like "The Godfather."

Retailers such as GameStop Corp and Best Buy Co Inc took advance orders for the game weeks earlier and many outlets threw open their doors at midnight to accommodate fans eager to be among the first to play.

The launch of "Grand Theft Auto 4" is expected to be the biggest entertainment event of the year, with first-week sales forecast to be up to $400 million, beating those of last year's "Halo 3" from Microsoft Corp.

At a GameStop store in midtown Manhattan, excited fans like John Alba and Enmanuel Lorenzo had been standing for hours in a line that nearly reached the end of the block to get their hands on the game.

"It gives you the opportunity to escape reality," Alba said. "This game has everything -- sex, drugs, cars, money ... anything you want."

"Grand Theft Auto 4" casts players as an Eastern European immigrant who runs drugs, shoots cops and beats up prostitutes after falling in with a crime syndicate -- stuff that has drawn fire from family groups and politicians.

Avid fans like Lorenzo seemed drawn to the excitement -- but only in game play. "Violence is like sex. It sells," Alba said outside the GameStop shop. "I like violence in games, it's cool. Not in real life."

DELAYED RELEASE A "SMART MOVE"

Judging from early reviews, "Grand Theft Auto 4" -- the latest version of the hit franchise made by Take-Two Interactive Software Inc's Rockstar studio -- appears on track to be the best-rated video game ever and one that could cement video games as a serious art form.

Its release, originally scheduled for October last year, was pushed back until Tuesday mostly due to technological hurdles.

But some viewed the late release positively.

"I think that it was actually a very smart move on their part to move it back because it gave a lot of people an opportunity to upgrade their systems to the next gen., so now there's actually a bigger chance of people going out and grabbing this game," said Chris Arsada, general manager of a GameStop store in Los Angeles.

"'Grand Theft Auto IV' is a violent, intelligent, profane, endearing, obnoxious, sly, richly textured and thoroughly compelling work of cultural satire disguised as fun," The New York Times said.

New York fans pointed to the game's graphics, music, its multi-player feature and importantly, its location in "Liberty City" -- a fictional setting that resembles New York City -- as reasons they found the game racy.

"The story line is probably one of the best, its more realistic," said Carlos Garcia, a Brooklyn resident who was at the GameStop store in Manhattan.

"MODERN-DAY MASTERPIECE"

Based on more than a dozen reviews compiled by Metacritic, a widely tracked aggregator of gaming reviews, the version of GTA4 for Sony Corp's PlayStation 3 game console has scored a perfect 100, while that for Microsoft Corp's Xbox 360 achieved a 99.

For LA gamer Johnny Cervantes, it was all about "Very good graphics, better strip club scenes, multi-world play, multiplayer, very excited for that, multiplayer."

"Rockstar's magnum opus is a modern-day masterpiece that could change the way the world views video games," gaming news and reviews Web site GameSpy wrote, awarding the game a perfect five-star rating.

"You'll quickly come to realize that the nuanced story telling and presentation is on par with the finest films by directors like Martin Scorcese or Francis Ford Coppola."

Shares of Grand Theft Auto publisher Take-Two rose 1 percent on Monday, helped by the positive early reaction.

That could help the company's bargaining position as it faces a $2 billion takeover offer from rival Electronic Arts Inc.

Take-Two Chairman Strauss Zelnick has rejected EA's offer as too low and insisted on waiting until after the game's launch before entering discussions.

---I can't wait for this to drop and I'm not even a gamer! this is one of those games I can play after a long day of putting up with pig vomit!

Buffett says recession may be worse than feared

April 28, 2008 11:09 AM ET

NEW YORK (Reuters) - Warren Buffett, the world's richest person, said on Monday the U.S. economy is in a recession that will be more severe than most people expect.

Buffett made his comments on CNBC television after his Berkshire Hathaway Inc agreed to invest $6.5 billion in the takeover of chewing gum maker Wm Wrigley Jr Co by Mars Inc in a $23 billion transaction.

"This is not a field of specialty for me, but my general feeling is that the recession will be longer and deeper than most people think," Buffett said. "This will not be short and shallow.

"I think consumers are feeling gas and food prices," he added, "and not feeling they've got a lot of money for other things."

He was not immediately available for further comment. Known for his frugality, the 77-year-old Buffett has lived in the same 10-room Omaha, Nebraska, house for a half-century, despite being worth an estimated $62 billion.

On Wednesday, the U.S. Commerce Department is expected to say how fast the economy grew in the first quarter. Economists on average have projected that gross domestic product grew at an annualized 0.2 percent rate in the quarter.

Two quarters of declining GDP is a traditional indicator of recession. That last happened in 2001. Economists expect the U.S. Federal Reserve on Wednesday to cut a key lending rate for a seventh time beginning last September.

Berkshire is a $197 billion conglomerate best known for its insurance holdings, such as auto insurer Geico Corp, but it owns more than 70 businesses.

Many of those businesses are tied to the housing market, including Acme Brick Co, insulation maker Johns Manville, and the real estate brokerage HomeServices of America Inc.

Others depend on consumers to spend more on discretionary items, such as Ben Bridge Jeweler and Borsheims Fine Jewelry.

"In the retail businesses ... if anything, they've gotten a little worse," Buffett said. "Of course, things connected with housing, whether it's in brick or whether it's in carpet, those businesses have shown no uptick at all. Jewelry had a bad Christmas ... and it stayed that way."

Buffett sees no respite from the housing slump.

"I think this is going to be fairly long and fairly deep, but who knows," he said.

In March, Forbes magazine pegged Buffett's net worth at $62 billion, ahead of Mexican tycoon Carlos Slim's $60 billion and Microsoft Corp Chairman Bill Gates's $58 billion. Gates is a friend of Buffett and a Berkshire director.

This is going to be some of the hardest times that the country is going to see but look on the bright side...we all get a check in the mail ($600.00 or so) to spend on whatever we want!!! That's great right? Until next year when we have to give it back and our tax returns are that much smaller....this is one of "the current administration's" last ways to fist us...other than $4 gas.

OSAMA BIN LADEN NOT THE DUDE TO BLAME FOR 9/11?

WASHINGTON (CNN) -- Prescott Prince is a small-town lawyer who has never taken a death penalty case to trial. Yet he finds himself involved in one of the biggest capital punishment cases this century: He's defending the alleged mastermind of the September 11, 2001, terror attacks, Khalid Sheikh Mohammed.

Prescott Prince says the suspected 9/11 mastermind deserves a fair trial.

He readily acknowledges how his client is perceived as "one of the most reviled people" in the world. But he says it's imperative America give Mohammed a fair trial, just like anyone else accused of a crime.

No civilian court, he says, would accept confessions obtained after a defendant was mistreated. But the CIA admits Mohammed was waterboarded, a controversial interrogation technique that involves simulated drowning.

"I take the position that this is mock execution. ... Colloquially speaking, at least it's torture," Prince says.

The fact whatever Mohammed said during such duress could be used at trial is alarming to Prince.

"That's not the rule of law. That's just insanity." Video Watch waterboarding is "mock execution" »

A Navy reservist who has been called to active duty, Prince, 53, rejects the suggestion that he is less than patriotic for representing an accused terrorist. "I had friends who were at the Pentagon the day it was attacked so I don't accept the concept of 'gee I don't know what it's like.'"

Prince is currently visiting the detention center at Guantanamo Bay in Cuba to meet his client. He was denied a meeting with Mohammed on Wednesday due to procedural problems; he will try again today.

Before Prince headed to Guantanamo, he told CNN he had no idea whether Mohammed will accept him as his lawyer. He says he's gone over what he's going to say "about a hundred times a day."

He's been reading the Koran and has met with psychologists and other lawyers who have represented accused terrorists. "This would not be the first time I've met with a client who initially did not want, if you will, court-appointed counsel," he said. "I've had clients call me almost any name in the book. I've had them refuse to come see me." Video Meet the attorney defending suspected 9/11 mastermind »

Still Prince realizes this is different. Very different.

Mohammed has been in custody since he was caught in Rawalpindi, Pakistan, in 2003. He was transferred from a secret location to Gitmo in 2006. The government says he confessed to his involvement in the September 11, 2001, attacks and many other terrorist plots.

The government in February said six terror suspects, including Mohammed, would go before military commissions and could face the death penalty if it is judged they were involved in the September 11 attacks. The proceedings are governed by the Military Commissions Act, which Congress passed to handle arrestees in the war on terror. See the terror suspects who could face the death penalty »

The act requires detainees have access to lawyers as well as to any evidence presented against them. They also will have the right to appeal a guilty verdict, potentially through a civilian appeals court and perhaps the U.S. Supreme Court, according to the act. Video Watch general describe charges against al Qaeda suspects »

In the case of Mohammed, the government acknowledged he was subjected to waterboarding, a harsh interrogation technique that many experts believe violates the Geneva Conventions' ban on torture. Waterboarding involves strapping a person to a surface, covering the face with cloth and pouring water over the cloth to imitate the sensation of drowning.

Prince finds that extremely troubling because he says a civilian court would never admit evidence gained through a coerced statement. The government says Mohammed has confessed to 9/11 and other terror plots.

"Even the greenest deputy sheriff or rookie police officer in Skunk Hollow County knows that if you rough up a defendant, anything he says after that is not going to be admitted into court," Prince says. "The officer might not like those rules, but he understands them and will abide by them."

But a judge in a military commission could have it entered into evidence. "We have created a system under the military commissions that says in essence, 'if he was roughed up, but what he says still seems reliable, we'll accept it any way.' And that's just wrong."

Prince says there are other complications. He may not have the chance to cross-examine Mohammed's accusers and may not see all the evidence to be put forward in court. Video Watch families of 9/11 victims push for fair trials »

Prince doesn't believe Mohammed can get a fair trial and says the country risks trashing "our constitutional values when it becomes convenient to do so."

"I don't want to impugn anyone's character, but this is where Ronald Reagan's term 'trust but verify' will come into play," he says.

The military has assigned him a three-person team consisting of another lawyer, an intelligence analyst and a paralegal. The American Civil Liberties Union and the National Association of Criminal Defense Lawyers have also teamed up to find volunteers to help Prince and the other lawyers defending accused terrorists at Guantanamo Bay.

Norman Reimer, the executive director of the NACDL, explained the daunting task this way:"It's going to require all of the ingenuity and resources -- not just to defend the accused -- but to defend the American system of justice and what we stand for in the world. That's what this is about."

Two lawyers from Boise, Idaho, have agreed to help Prince. No strangers to terrorism cases, David Nevin and Scott McKay won an acquittal for a Saudi man who faced terror charges.

Prince for years ran a small practice in Richmond, Virginia. But last year, the reservist was called to active duty and spent six months in Iraq. He never thought this would be his next assignment.

"I could have said, 'No,'" he says, before adding, "I don't think I would have been doing honor to myself or honor to my calling."

Official: Polygamists Got 31 Underage Girls Pregnant

A Texas child welfare official has confirmed that of the 31 of the 53 girls between the ages of 14 and 17 living at the Yearning For Zion Ranch are either pregnant or have given birth to children.

Texas officials took 463 children into custody earlier this month, following a raid of the ranch after a phone call was made to a domestic violence hotline.

It is believed that young girls were forced into marriages with much older men.

Captive Austrian Kids Never Saw Sunlight

AMSTETTEN, Austria (Reuters) - A 73-year-old Austrian electrical engineer has confessed to holding his daughter captive in a secret, windowless cellar for 24 years and fathering seven children by her, police said on Monday.

The case, centered on a nondescript two-story building in the small industrial town of Amstetten, bears chilling similarities to that of Austrian Natascha Kampusch who spent eight years locked up in a basement before escaping in 2006.

Some parts of the cell in which the family were kept were no more than 5 feet 6 inches high and officials said the basement even contained a padded cell.

"This is an appalling crime. I know of no comparable case in Austria," Franz Prucher, head of security for Lower Austria told a news conference.

Elisabeth Fritzl, 42, says her father, Josef Fritzl, lured her into the basement of the block in 1984 and drugged and handcuffed her before imprisoning her.

Three of her children, aged 19, 18 and 5, had been locked up in the basement with her since birth and had never seen sunlight, police said, raising worries about their physical and mental state. The younger two were boys, the eldest a girl.

Three other children -- two girls and one boy -- were brought up by Josef and his wife.

As well as confessing to locking up his daughter for 24 years and siring the seven children, Fritzl also admitted to burning the body of the seventh child in the heating system when it died soon after birth, said Franz Polzer, head of criminal investigations in the state of Lower Austria.

All the victims are receiving medical treatment, said police. State prosecutors said Fritzl would be summoned before a judge later on Monday.

Investigators spent the day combing through the cells where the victims had been held captive. Forensic experts in white uniforms and gloves carried out boxes of evidence from the house which is on a busy street with shops.

Fritzl had hidden the entrance to the cell behind shelves and only he knew the secret code for the reinforced concrete door, said officials.

Photographs showed a narrow passageway leading into other rooms which included a cooking area, sleeping area and a small bathroom with a shower. A tube provided ventilation.

Amstetten, located in rolling hills about 130 km (80 miles) west of Vienna, is an industrial town of about 22,000 people.

HOSPITAL VISIT

The case unfolded when the 19-year-old girl became seriously ill and was taken to hospital, prompting doctors to appeal for the girl's mother to come forward to provide more details about her medical history.

Fritzl then brought Elisabeth and her remaining two children out of the basement, telling his wife -- who thought their "missing" daughter had chosen to return home, police said.

Elisabeth agreed to make a comprehensive statement to the police after receiving assurances she would have no further contact with her father, who she said abused her from the age of 11.

Kampusch, who spent her teenage years held captive, offered to help the victims and told ORF radio she might talk to the family.

"I can imagine that it is very difficult both for the mother of the children as well as for the wife of the perpetrator to get through this," she said.

Psychiatrist Max Friedrich, who treated Kampusch, said the children were undergoing tests in hospital, in particular for problems with their eyes and skin due to the lack of daylight.

"And socially ... the (children) could not develop any sort of sense of community which they would get from going to school or playgroup," Friedrich told Reuters.

SHAME

The case has raised questions about how authorities and neighbors failed to notice anything unusual in the "house of horrors," not least because officials said Fritzl had over the years built extensions to the secret cellar.

"The community of Amstetten should drown in shame ... The neighbors are turning a blind eye," the Oesterreich newspaper wrote in an editorial.

The daily Der Standard wrote: "The whole country must ask itself what is really, fundamentally going wrong."

Another puzzle is how Josef's wife Rosemarie could have been unaware of what was going on.

Police have said they believe Rosemarie did not know what happened to her daughter when she disappeared in 1984. It was assumed Elisabeth had left voluntarily when her parents received a letter from her saying they should not search for her.

ON THE SHOW MONDAY NIGHT!!!

There's a lot to be covered on Monday night on the Jumpoff!!!

first off, we (Riske & I) spent the inaugural weekend of the Naturals at the Arvest Ballpark...

good times whatnot...the game's a lot better to watch in person then on TV...

Now for the meat of the matter:

MEN NOW ABLE TO GET BIRTH CONTROL SHOTS?

News.Com.Au

NEW Australian-developed contraceptive jab for men, taken four times a year, has been proven to be just as effective as birth-control pills for women.

Sydney researchers found the hormonal injection is a quick and reliable method of contraception for up to 95 per cent of males.

Until now, the only effective non-barrier contraceptive for men was a vasectomy, meaning that women tended to take on theresponsibility.

Now there is an alternative - but pharmaceutical companies have shown little interest in making it available to the public.

The new jab works by suppressing sperm output but does not have a permanent effect.

Made up of a combination of the hormones androgen and progestin - mostly testosterone - it needs to be administered every two to three months.

Researchers from the ANZAC Research Institute, University of Sydney and Concord Hospital studied 1756 men aged 18 to 51 and found the combined jab was quicker and more effective than an androgen-only version.

Associate Professor Peter Liu, co-author of the integrated analysis study, said he was disappointed pharmaceutical companies had pulled out of the project to develop a commercially available male contraceptive jab.

"I think there's a real need for it because I see a lot of couples where a female doesn't want to use or is intolerant to a female contraceptive pill or males who want to delay vasectomy" Professor Liu said.

"There are also couples who say it's not fair, why should (birth control) be up to the female? I hear that from both partners."

Research has been hindered by a shortage of government interest and funding.

"My perception is that people want it but it seems to be that somehow that isn't being heard at a government level," Professor Liu said.

"No one has really pushed this issue and I don't know why that is. Sometimes, the Government doesn't know what the community wants so the community has to tell them."

The jab is as effective as a vasectomy without the need for surgery or stopping sperm completely, according to the study which has been published in the Journal of Clinical Endocrinology and Metabolism, and Medical Observer magazine.

"We conclude that androgen-progestin administration can suppress sperm output in a timely fashion to concentrations that are compatible with reliable contraception in most, but not all, men," the study authors wrote.

"The rate of suppression is comparable to that achieved after vasectomy."

The World Health Organisation is understood to be planning an international study to test a three-monthly androgen-progestin combination injection for men.

Countries such as China, where population growth is exploding, are expected to be among the biggest markets for the new jab.

DAVE CHAPELLE MADE US DRESS UP IN KLAN OUTFITS!

Two troopers at the Sandusky post of theOhio State Highway Patrol nearly lost their jobs after one snapped a photo of the other dressed up in a Ku Klux Klan-like outfit and sent thepicture to another trooper.

The third trooper, who worked at theNorwalk post, was also in hot water for his role in the incident.

The picture was taken with a cell phone camera at the Sandusky post on Jan. 20, 2008 -- the day before the national holiday tohonor slain civil rights leader Dr. MartinLuther King Jr.

Troopers Eric E. Wlodarsky and Craig T. Franklin, who were both on duty at the time, told an investigator the picture was taken as a joke and modeled after a skit by comedian Dave Chappelle.

The investigation began when the highway patrol's Administrative Investigative Unit received an anonymous letter postmarkedJan. 22 from Mansfield.

In the letter were two photographs ofuniformed Franklin "in a handmade outfit, which resembles that worn by Ku Klux Klan"members, according to an interoffice memo.

Also included in the envelope was a note that read "Sergeant Wlodarsky on duty at theSandusky Post on January 20, 2008. What a way to represent the Ohio State Highway Patrol!"

Franklin, a 12-year veteran, is pictured "with a white cone sitting on his head, white paper mask with eye holes in front of his face and white cloth covering the shoulders," according to a patrol document.

The well-known KKK outfit with a white hood and mask is an iconic image of racism.

The report added that one can see equipment including "a handgun holster, vehicle audio microphone, double magazine holder, mace holder and radio as issued by the Ohio State Highway Patrol."

'WITH A JOKING INTENT'

Wlodarsky told an investigator he forwarded the picture via text message to Sgt. Jason P. Demuth at the Norwalk post.

Demuth forwarded the picture to dispatcher Gaby Highlander, who works at the Toledo post, according to an investigation by Sgt. Jeffrey P. Bernard.

Wlodarsky told an investigator there was "no malicious intent" behind the picture and Franklin was a "joker" and posed for the picture "with a joking intent."

Franklin, Wlodarsky, another trooper and a dispatcher were discussing MLK Day at thepost on the day the picture was taken.

Wlodarsky told the investigator it was "his bad" to allow Franklin to dress up in the Klan garb.

"Sgt. Wlodarsky said there was no specific reference to the outfit looking like KKK, but supposes it would to the average person," Bernard wrote in his report. "He said after Franklin had thrown the outfit away, he told Franklin the gesture was not the best thing to do at work or in general."

The idea to dress up in the Klan outfit was hatched from a skit done by Chappelle, a black male comedian, Franklin told Bernard. Bernard wrote in his report he was able to find the skit on the Internet.

Franklin told investigators he was in the outfit for about a minute and "truly sorry." He admitted "it was the wrong thing to do" and was "embarrassed that he did it," Bernard wrote in the report.

DISCIPLINARY MEASURES

Henry Guzman, director of Ohio Department of Public Safety, intended to fire both Wlodarsky and Franklin based on Bernard's investigation.

Thanks to their union contract, both were allowed to keep their jobs under a "last chance discipline agreement," following a pre-disciplinary hearing March 24.

The agreement provides an employee a last chance to correct his behavior. The employee can be fired if he violates patrol rules in the next two years. If an officer who enters into the agreement maintains a clean record for that period of time, record of the incident will be wiped from his record.

Both Wlodarsky and Franklin will be terminated if they violate rules of "conduct becoming an officer," a patrol spokesman said. He said conduct issues are "very broad."

Wlodarsky was demoted from sergeant to trooper and transferred to the Norwalk post. He can never be reassigned to the Sandusky post and must attend a diversity awareness class.

Franklin was placed on a five-day unpaid suspension. He must also attend diversity awareness training, according to patrol documents.

Demuth was given a one-day suspension for failing to report the incident to a supervisor and forwarding the photo to a subordinate.

"Obviously, we're extremely disappointed in the action of the three officers," said Lt. Shawn Davis, a spokesman for the patrol. "This kind of conduct cannot and will not be tolerated."

STATEWIDE REACTION

Thirteen troopers are assigned to the Sandusky post, which patrols highways in Erie and Ottawa counties. None of the 13 are black.

The patrol worked swiftly to investigate the incident, realizing the sensitivity of the issue, Davis said.

"It's not acceptable," he said. "That's why we took action."

Lt. Greg Greggila supervised Wlodarsky and Demuth at the Sandusky post.

"I've never had a problem with them, they are good officers," Greggila said. "They made a mistake and unfortunately they got what was coming to them as a result of that."

Greggila said neither man is a racist.

The state attorney general's office does not plan to look at the case as a potential hate crime, said spokesman Ted Hart.

"If a local police department or prosecutor asked us to look at it, that is something that we would take a look at," he said. "We would not step in on our own."

Gov. Ted Strickland knew of the picture, said Keith Dailey, a spokesman for the governor.

"The governor was extremely disappointed to learn of these troopers' actions," Dailey said, adding Strickland called the actions of the troopers "inappropriate" and "unacceptable."

None of the troopers had been in trouble prior to the Jan. 20 incident, according to documents released to the Register.

Wlodarsky was involved in a preventable patrol car crash when he ran into the rear of a semi truck that was stopped for a school bus. He was given a verbal reprimand for that incident.

The personnel records for Franklin and Demuth showed no entries prior to the KKK prank.

Davis could not recall any similar incidents at other patrol posts.

He said minorities should not lose faith in the patrol, despite the inflammatory nature of the picture.

"The integrity of the patrol is held to a high standard and is something that concerns us," Davis said. "These three (officers' actions) don't represent the 1,500 hard-working men of the highway patrol."

WTF PT. 2
DR. PHIL STICKIN HIS FAT ASS WHERE IT DOESN'T NEED TO BE...AGAIN!

Television talk show host "Dr. Phil" McGraw's show helped a central Florida teenager accused of taking part in a videotaped beating bond out of jail, a spokeswoman confirmed Saturday.

Staff members for the "Dr. Phil" talk show helped Mercades Nichols -- one of eight teens facing charges in the case -- post bond this weekend, McGraw spokeswoman Theresa Corigliano said in an e-mail.

"We have helped guests and potential guests in the past when they need financial assistance to come on the show -- assisting with clothing allowance, lost wages, accommodations, travel and necessities," Corigliano wrote. "In this case, certain staff members went beyond our guidelines (re the bail being paid). These staff members have been spoken to and our policies reiterated. In addition, we have decided not to go forward with the story as our guidelines have been compromised."

Late Saturday night, Polk County Sheriff's Office spokesman Scott Wilder said only two of the eight teens remained jailed.

The eight teens, whose ages range from 14 to 18, face kidnapping and misdemeanor battery charges. Three also face a felony charge of witness tampering.

They are accused of participating in a violent beating of another teenager, which was videotaped and has now been viewed widely on national TV and the Internet.

A judge set bails ranging from $30,000 to $37,000 for each during their first court appearances Friday. The state attorney's office says all will be tried as adults.

McGraw drew criticism earlier this year when he confronted troubled pop star Britney Spears at the UCLA Medical Center during a stay at the facility.

At one point, McGraw had planned an episode of the "Dr. Phil" show about Spears, but quickly abandoned the idea. He has since apologized for discussing his visit publicly -- but not for going to see her.

IT'S THE END OF THE WEEKEND!!!!

PAC & BIGGIE STILL FORCES TO BE RECKONED WITH...

On any given night in any given city during any given hip-hop concert, there usually comes a point when the performer salutes hip-hop's most famous fallen heroes. It's a codified ritual. Audience members are instructed to "put your twos in the air," raising two fingers in honor of Tupac Shakur. Inevitably, the memory of the Notorious B.I.G. also is invoked.

Shakur's mother has witnessed the scene, again and again.

"I'll tell you something -- I don't want to say it's still overwhelming, but it's always surprising," said Afeni Shakur, formerly a high-profile member of the Black Panther Party.

"When Tupac died, we thought it was just us mourning," she said. "Then we realized Tupac didn't just belong to us, his family. He belonged to the world."

Rival rappers Shakur and the Notorious B.I.G., aka Biggie Smalls, were gunned down in drive-by shootings in September 1996 and March 1997, respectively. Shakur was 25; the Notorious B.I.G. was 24. Their deaths remain unsolved, even as the shadows cast across the pop-culture landscape by these multiplatinum rap superstars grow longer with each passing year.

Their legacies live on
Shakur and the Notorious B.I.G. "were the first people in hip-hop to reach icon status," said Bakari Kitwana, a hip-hop lecturer and author of "The Hip Hop Generation," among other books.

"They had cross-cultural appeal," Kitwana said. "People liked Run-DMC, but it wasn't the same. They weren't posting those kinds of [sales] numbers."

The hits keep coming for Shakur and the Notorious B.I.G., too. Both MCs have sold more albums posthumously than when they were alive.

Shakur left behind nearly 300 unreleased songs when he died, said Tre Maxie, director of the Tupac Amaru Shakur Center for the Arts.

Most of those songs eventually saw the light of day, although enough material remains to fill a couple more albums, Maxie said.

"There's talk of doing a boxed set, too, but it's not confirmed," he said.

Sales of Shakur's albums help support the Tupac Amaru Shakur Foundation, established by Afeni Shakur in 1997, and the arts center bearing his name, which opened three years ago outside Atlanta. The foundation and the center specialize in youth-oriented arts programs, although they're also involved with other initiatives, ranging from nonviolent conflict resolution to organic gardening.

"Who would've thought -- Tupac and the environment!" Maxie said. "We want to use his impact all over the world to help young people all over the world."

Voletta Wallace, mother of the Notorious B.I.G. (whose real name was Christopher Wallace), also established a foundation in memory of her son, dedicated to educating inner-city youth. She declined to be interviewed for this story.

Huge numbers and strong lyrics
Tupac Shakur is the top hip-hopper on the Recording Industry Association of America's list of best-selling artists, with 36.5 million records sold -- more than the career totals for the likes of the Doors, Willie Nelson or Tom Petty & the Heartbreakers.

The Notorious B.I.G. ranks further down the list, with 17 million records sold.

He may not be on equal footing with Shakur when it comes to commercial success, but some would say the Notorious B.I.G. was the more gifted MC.

"In terms of his lyrical ability, Biggie was definitely superior," Kitwana said. "He captured a sense of street culture in a way that other people weren't able to articulate.

"In black-power circles, people refer to the struggle as the political movement, but he began to refer to the struggle as just the struggle to survive out here every day."

Latter-day admirers such as 50 Cent, Chingy and Bobby Valentino sing the Notorious B.I.G.'s praises on "Can I Speak to Biggie," a new tribute song.

His profile stands to get an even greater boost in January, when the biopic "Notorious" arrives in theaters. Filming began last month, with up-and-coming rapper Jamal Woolard (alias Gravy) in the lead role. George Tillman Jr., whose previous credits include "Soul Food" and "Men of Honor," is directing the movie.

A Shakur biopic is also in the works, although the project is still in the development stage, Maxie said.

No stranger to the big screen, Shakur made several films, including 1993's "Poetic Justice," in which he starred opposite Janet Jackson.

Shakur and the Notorious B.I.G. "touched a lot of people when they were here," said Wish Bone (real name: Charles Scruggs) of Bone Thugs-N-Harmony, Cleveland's Grammy-winning rap group.

"If their music came out today, it would still be relevant," Wish Bone said. "It's just good music."

Bone Thugs-N-Harmony recorded songs with Shakur ("Thug Love") and the Notorious B.I.G. ("Notorious Thugs"), despite the bad blood between the Shakur and the Notorious B.I.G. camps.

"It definitely got out of hand," Wish Bone said of the West Coast-East Coast feud personified by Shakur (representing the West) and the Notorious B.I.G. (representing the East).

"We always stayed neutral," Wish Bone said. "When we had a beef with somebody, we would take our beef straight to them. We were never into battling on songs.

"For us to be able to get together with two legendary artists was a blessing."

Shakur and the Notorious B.I.G. are still touching people, and not just in the hip-hop realm.

Flip through the new book "Tupac Remembered: Bearing Witness to a Life and Legacy," and you'll find testimonials from professional athletes Baron Davis and Chris Hayes, politician Cynthia McKinney and poet Nikki Giovanni, who sports a "Thug Life" tattoo like the one Shakur had.

"I want people to know Tupac's legacy is not a legacy of violence," Afeni Shakur said. "It's not the legacy of a gangsta rapper. He's bigger than that.

"He was a musician. He was a poet. He was an actor. And he was an activist."

Unsolved slayings leave many wondering
Shakur and the Notorious B.I.G. continue to receive the requisite shout-outs from today's rappers, too.

"They've taken on this larger-than-life personification, especially among people who really weren't their contemporaries," said lecturer/author Kitwana. "Many artists who are out now were still kids when Tupac and Biggie were killed. They don't really know them. They just know what they've heard about them.

"In terms of invoking their memories . . . it's almost like the way activists may invoke Huey Newton. Or it's like people rocking a Che Guevara shirt."

While interest in Shakur and the Notorious B.I.G. never seems to wane, it flared up again when The Los Angeles Times published a story last month about a 1994 assault on Shakur, purportedly orchestrated by associates of Sean "Diddy" Combs, the Notorious B.I.G.'s mentor. The newspaper has retracted the story, which turned out to be based on forged FBI documents.

"That stuff in the L.A. Times was nothing new -- same thing they said when he was shot," Afeni Shakur said.

"Did they tell you who did it? No. So it's nothing new.

"The legacy is what he left for us to do. So we deal with the work. We don't do a lot of wondering."

Others can't help but still wonder about the circumstances surrounding the deaths of Shakur and the Notorious B.I.G. Nobody has been charged in their shootings.

"If a conspiracy can hit a president, you know it can hit the rap game," Wish Bone said. "Every time black folks in general do something good, something that makes money for the black race, it's always looked upon as something bad. . . . They try to shut it down.

"I definitely think the murders were related. Who was behind it? Who knows? We know it was the powers-that-be, people who didn't want those messages out there."

Shakur and the Notorious B.I.G. "were getting too powerful," Wish Bone said. "Anytime you're selling millions and millions of records and your message is heard, it means people are believing what you believe in -- and that's very dangerous in today's world."

Of course, pop culture tends not to allow its legends to rest in peace; just ask those people who swear Elvis Presley is alive and well and frequently patronizing fast-food joints. Whether you choose to accept it, however, at least the King's death is a closed case.

The same can't be said of the slayings of Shakur and the Notorious B.I.G.

"If you can reach the status of a Tupac or a Biggie and someone kills you and no one in government says, 'We're going to find these murderers no matter what,' or no one in law enforcement says, 'We're not going to sleep until the murders are solved,' what does that say to you?" Kitwana said.

"That, to me, is the real tragedy of Tupac and Biggie. . . . Could you imagine Paris Hilton getting shot and we never find out who killed her? Or Britney Spears?

"It shows you how black men are not taken seriously."

In the eyes of some, Shakur and the Notorious B.I.G. have attained martyr status.

Shakur's mother will leave it to others to decide if the tag fits.

"His fans dictate whether or not he's a martyr," Afeni Shakur said. "I don't know, nor do I care. . . . I'm a mama who lost a son."

ALICIA KEYS THE CONSPIRACY THEORIST?

NEW YORK — There's another side to Alicia Keys: conspiracy theorist. The Grammy-winning singer-songwriter tells Blender magazine: "`Gangsta rap' was a ploy to convince black people to kill each other. `Gangsta rap' didn't exist."

Keys, 27, said she's read several Black Panther autobiographies and wears a gold AK-47 pendant around her neck "to symbolize strength, power and killing 'em dead," according to an interview in the magazine's May issue, on newsstands Tuesday.

Another of her theories: That the bicoastal feud between slain rappers Tupac Shakur and Notorious B.I.G. was fueled "by the government and the media, to stop another great black leader from existing."

Keys' AK-47 jewelry came as a surprise to her mother, who is quoted as telling Blender: "She wears what? That doesn't sound like Alicia." Keys' publicist, Theola Borden, said Keys was on vacation and unavailable for comment.

Though she's known for her romantic tunes, she told Blender that she wants to write more political songs. If black leaders such as the late Black Panther Huey Newton "had the outlets our musicians have today, it'd be global. I have to figure out a way to do it myself," she said.

The multiplatinum songstress behind the hits "Fallin'" and "No One" most recently had success with her latest CD, "As I Am," which sold millions.

CHEERLEADERS DELIVER A BEATDOWN...

http://www.wltx.com/news/story.aspx?storyid=60657
Lakeland, Florida (WTSP) – Lakeland, Florida - The Polk County Sheriff's office released the video of a teenage girl who, as Sheriff Grady Judd puts it, was "lured so her friends could beat her."

The video shows what Judd says is the second of five beatings the 16-year-old received from people she knew. The attackers say they were upset with so-called "trash talk" the victim posted on her MySpace page, and they say they wanted to post their own video of the beating on MySpace and YouTube.

The sheriff says the victim was first beaten unconscious in a bedroom. When she awoke, she was on a couch in the living room, where the screaming and beatings continued.

"It is disgusting that the attackers find it funny and want to post something on the Internet showing someone nearly beaten to death," says the victim's mother.

Sheriff Judd is calling it one of the most disturbing videos he has seen in a long time and he hopes all those arrested will be tried as adults. They face charges ranging from felony battery, false imprisonment to kidnapping. The sheriff says the attackers "were relentless."

Even though those involved could face prison time, Judd says the teens showed no remorse after their arrests.

"When they were in a holding cell, they were all laughing," Judd says. "One of the teens arrested, who is a cheerleader, asked, 'Does this mean I'm going to miss cheerleading practice tomorrow?' The others were cutting up and said, 'It looks like we won't be going to the beach this weekend.'"

While the attackers can laugh off the incident, the victim's mother certainly can't.

"You never think it will happen to your family," she says. "To have this happen and see it... is hard to bear."

Polow Da Don On Beat Jacking Rumors

Accused of using preset music software to produce his six figure beats, Atlanta producer Polow Da Don spoke with SOHH exclusively to clear up those allegations, while also responding to rumors that he's behind recent Beyoncé leaks.

A YouTube video sparked an uproar Thursday over Usher's #1 hit "Love in This Club," which was produced and co-written by Polow.

In the short video, an unidentified young man plays a snippet of "Love in This Club," then demonstrates two presets from Apple's GarageBand program which sound nearly identical to the track -- instantly threatening the credibility of one of hip-hop's hottest producers. [Click here to watch]

"That's not where I got them from, but they're definitely in there," Polow said of the sounds used in "Love in This Club," telling SOHH he had yet to view the YouTube video. "There's this keyboard I have that a lot of sounds come in."

Polow noted that the song contains a live bassline and that Robin Thicke was enlisted to play piano on the record.

"If a ten-year-old can make 'Love in This Club' and save Usher's career and make black women want to f*ck him again, after they was done with him for getting married, then sh*t he's a genius just like me," Polow said. "I also wrote the hook - that's not a preset."

While he's taken flack in recent months for leaking "Love in This Club" before it was set to drop, many of his detractors were silenced after the song made Billboard history by reaching #1 in record time.

"I can charge six figures because I make companies hundreds of millions of dollars," Polow explained. "It's a small percentage of earnings. I'm one of the most influential people in music, not just on the production side, behind the scenes! Even me having the balls to leak an Usher record -- I put my career and my relationship on the line, but I did that all because I really believed in the music. "

"It went number one in three weeks," he boasted! "Mariah Carey was planned, Janet Jackson was planned, money was put behind those projects. This record was shipped from my computer in my hotel room."

After admitting to leaking "Love in This Club," suspicion immediately fell on Polow last week when a couple of previously unreleased Beyoncé tracks hit the net, however Polow denies any role in that.

"They are probably saying that so it will go number one in three weeks, but that's probably somebody that's on over there, trying to make it seem like I leaked it," Polow said.

Always hard at work, Polow Da Don says times are good for music fans, who can look forward to hearing his recent collaboration with Nas, Lil' Wayne and John Legend soon, as well as the upcoming album from his Zone 4 artist Keri Hilson.

50 Cent Fires Young Buck From G-unit

50 Cent has axed fellow rapper Young Buck from his G-Unit group, after he spoke out about dissent within the ranks of the "In Da Club" star's collective.

Young Buck, real name David Darnell Brown, was quoted in a recent interview with Yo! Raps magazine bemoaning the fact he'd "never seen a royalty check" since signing with 50's G-Unit Records imprint - despite releasing his two albums, 2004's Straight Outta Cashville and 2007's Buck The World, on the label.

However, the allegations were blasted by the star's manager Sha Money XL, who claimed the quotes had been fabricated, insisting G-Unit has paid Young Buck $10 million to date.

Rumors of a rift between 50 and Young Buck have been around for months, after the "Shorty Wanna Ride" rapper was alleged to have signed with rival label Cash Money Records in January 2008.

That report proved to be false, as did another claim that 50 was on the verge of firing Young Buck after he failed to join the G-Unit group on tour, or feature on their February 2008 mixtape.

But now superstar 50 Cent has cleared up the rumors once and for all, by confirming Young Buck's departure from the group. Yet, he will continue on G-Unit Records in a solo capacity.

And 50 has compared the long-running feud with Young Buck to the infamous sacking of The Game from G-Unit in 2006.

Speaking to a radio station Monday, he said, "You can look at it and see that's Game all the way.

"I was giving him a chance, giving him the benefit of the doubt (to remain with the group). You can take this as an official notice right here - pretty much you can say: Young Buck is no longer in the group G-Unit, but signed to G-Unit (Records) as a solo artist."

Tina Fey, Oprah Winfrey

Oprah to be on 30 Rock
Just two weeks ago, while discussing some dream casting options for her NBC comedy 30 Rock, Tina Fey told reporters, "I still want Oprah to play my best friend...and I don't know what I need to do to make that happen."

Well, as of today, it might happen. Chicagoland sources who were at the taping of The Oprah Show starring Tina Fey and Amy Poehler for Baby Mama just wrote in to tell us this fantastic news:

According to members of the live audience, during a commercial break, Oprah said she had heard Tina wanted to be her best friend and asked whether Tina meant in real life or on the show. When Tina said "both!" Oprah said, "Have your people call my people."

Oprah then said that she was "definitely interested" and would love to appear on the show, to which Tina gestured to the people in the audience, to the effect of "You heard it!"

So...Tina Fey and Oprah Winfrey? Together? If this happened, I would never ask the TV gods for anything ever again, because...seriously! Best boost ever. If Britney can lift How I Met Your Mother's ratings by 1 million, just think what freaking Oprah could do for the Rock. (That said, can we get her on Friday Night Lights and Reaper, too?)

Now, click in to take our 30 Rock guest superstars poll, and post about your dream-come-true cameo-makers in the comments!

Snoop Dogg Hit With Copyright Infringement Lawsuit

Rapper Snoop Dogg is facing legal action from a little-known songwriter, who has accused the star of copyright infringement for his latest single "Sensual Seduction."

Millennium Child, real name James D. Jenkins, claims the "Beautiful" hitmaker - real name Calvin Broadus - stole his "music strings" for the single from an audio tape he gave to the manager of rapper/actor Ice Cube in 2006.

The bizarre lawsuit, which was handwritten by Jenkins and filed in Colorado District Court this week, states: "I had hand (sic) Ice Cube manager (sic)1 tape... From there I don't know how Calvin Broadus got a hold of it. The tape."

But Jenkins is not seeking any damages in return - he's simply asking for the "documents related to the case," reports TMZ.com.
